1. Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of www.ptm.us (the "Site"), operated by Plastics Transformation Manufacturing ("PTM," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. The Site Is Informational

The Site presents information about PTM's plastic design, engineering, and manufacturing capabilities for operations in the United States and Canada. Content is provided for general information only. Product specifications, lead times, tolerances, and capability statements are indicative and do not constitute a binding offer, warranty, or guarantee. Any engagement is governed by a separate written agreement and, where applicable, a quotation accepted in writing.

3. No Warranty

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information is accurate, complete, or current.

4. Intellectual Property

The Site, including its text, layout, graphics, schematics, and the PTM name and marks, is owned by PTM or its licensors and is protected by applicable intellectual-property laws. You may view and print Site content for your own internal business evaluation. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission. Any specifications, CAD, or materials you submit to us are handled under our standard non-disclosure terms; your intellectual property remains yours. These Site terms do not supersede, replace, or modify any separately executed non-disclosure or commercial agreement between you and PTM; in the event of a conflict regarding confidential materials, that separate agreement controls.

5. Acceptable Use

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site or its systems; (c) interfere with the Site's operation or security; (d) introduce malware or automated scraping that burdens the Site; or (e) misrepresent your identity or affiliation when submitting inquiries.

6. Submissions and Inquiries

When you submit a quote request, RFQ, or other inquiry, you represent that the information you provide is accurate and that you are authorized to share any files or specifications you upload. Submitting an inquiry does not create a contract; it begins a commercial conversation governed by a subsequent written agreement.

7. Third-Party Links and Services

The Site may link to third-party sites or services we do not control. We are not responsible for their content, products, or privacy practices, and links do not imply endorsement.

8. Limitation of Liability

To the fullest extent permitted by law, PTM and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business, arising from or related to your use of the Site, even if advised of the possibility of such damages. In no event will PTM's total aggregate liability arising from or related to your use of the Site exceed one hundred U.S. dollars (US $100.00).

9. Indemnification

You agree to indemnify and hold harmless PTM from claims, liabilities, damages, and expenses arising out of your misuse of the Site or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. The state and federal courts located in Miami-Dade County, Florida shall have exclusive jurisdiction over any dispute, and venue lies exclusively in Miami-Dade County, Florida, unless otherwise required by applicable law.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance.
